1. 1.     SPLASHVISION NETWORK PRIVACY POLICY

Thank you for registering your User Name to obtain enhanced access to the network of Web sites and services offered by SPLASHVISION ("SPLASHVISION"). The SPLASHVISION Network improves your online experience by offering you access to a variety of features, offerings and content. By registering your User Name, you gain access to the SPLASHVISION Network, which consists of SPLASHVISION Enhanced Websites and Services such as Mail, and other content and offerings from the SPLASHVISION Network's affiliated providers (collectively the "SPLASHVISION Network" or "Network").

When you register with and use the SPLASHVISION Network, you provide the SPLASHVISION Network with personally identifiable information (your "SPLASHVISION Network information"). This Policy explains the information practices that apply to your SPLASHVISION Network information, as well as the choices you can make about the ways this information is used by the SPLASHVISION Network.

This Privacy Notice is incorporated into and is subject to the SplashVision Terms of Use. Your use of the SplashVision Network and any personal information you provide on the SplashVision Network remains subject to the terms of this Privacy Notice and our Terms of Use.

Registering to use your User Name with the SPLASHVISION Network is optional. This Privacy Policy applies only to information SPLASHVISION collects about you as a user of the SPLASHVISION Network. This policy does not apply to information about you collected by the SPLASHVISION Network's affiliated providers, or third party Web sites and offerings linked to or otherwise accessible from the SPLASHVISION Network. The information collected or received by the SPLASHVISION Network's affiliated providers and these third parties is subject to their own privacy policies.

1. 2.     Collection of your SPLASHVISION Network Information

Your SPLASHVISION Network information consists of personally identifiable information collected or received about you when you interact with the SPLASHVISION Network's Web sites, services and offerings as a registered user. Depending on how you use the Network, your SPLASHVISION Network information may include

·    Your SPLASHVISION Network information may be supplemented with additional information from other companies.Your SPLASHVISION Network information may also include certain technical information gathered or received when you use the SPLASHVISION Network. Some of the technical information that may be collected or received includes: the type of browser you are using (e.g., Netscape, Internet Explorer), the type of operating system you are using (e.g., Windows XP or Mac OS), CPU type (e.g. Pentium), your manner of connecting to the Internet (e.g., connection speed through narrowband or broadband access); Internet protocol address; other information about your geographic location; and the domain name of your Internet service provider.Your SPLASHVISION Network information may be collected and stored in the United States. Additionally, the SPLASHVISION Network will use the User Name Service, or similar technologies, to authenticate you on the SPLASHVISION Network and enable you to take advantage of Network offerings.

1. 3.     How Your SPLASHVISION Network information is Used

Your SPLASHVISION Network information is used

·   if you submit personally identifiable information to us through the SplashVision Sites, then we use your personal information to operate, maintain, and provide to you the features and functionality of the SplashVision Sites.
·   any personal information or video content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your public profile page, etc.) becomes publicly available and can be collected and used by others. Your account name (not your email address) is displayed to other Users when you upload videos or send messages through the SplashVision Sites and other Users can contact you through messages and comments. Any videos that you submit to the SplashVision Sites may be redistributed through the internet and other media channels, and may be viewed by the general public.
·   to operate and improve the Web sites, services and offerings available through the SPLASHVISION Network;
·   to personalize the content and advertisements provided to you;
·   to fulfill your requests for products, programs, and services;
·   to communicate with you and respond to your inquiries;
·   to conduct research about your use of the SPLASHVISION Network; and
·   to help offer you other products, programs, or services that may be of interest.

Your SPLASHVISION Network information may be shared with the Network's affiliated providers. You have choices about how your SPLASHVISION Network information is used, and whether affiliated providers receive personally identifiable information about you as a SPLASHVISION Network user. Affiliated providers that receive your SPLASHVISION Network information may use this information according to their applicable privacy policies.

Your SPLASHVISION Network information will not be shared with third parties unless it is necessary to fulfill a transaction you have requested, in other circumstances in which you have consented to the sharing of your SPLASHVISION Network information, or except as described in this Privacy Policy. The SPLASHVISION Network may use your SPLASHVISION Network information to present offers to you on behalf of business partners and advertisers. These business partners and advertisers receive aggregate data about groups of SPLASHVISION Network users, but do not receive information that personally identifies you.

If you use SPLASHVISION Network communications tools to disclose information about yourself publicly (for example, in chat rooms or online message boards made available by the SPLASHVISION Network), other online users may obtain access to any information you provide. The contents of your online communications, as well as other information about you as an SPLASHVISION Network user, may be accessed and disclosed in response to legal process (for example, a court order, search warrant or subpoena); in other circumstances in which SPLASHVISION believes the SPLASHVISION Network is being used in the commission of a crime; when we have a good faith belief that there is an emergency that poses a threat to the safety of you or another person; or when necessary either to protect the rights or property of SPLASHVISION, the SPLASHVISION Network or its affiliated providers, or for us to render the service you have requested.

The SPLASHVISION Network may use agents and contractors in order to help operate the Network. If such agents and contractors have access to personally identifiable information, they are required to protect this information in a manner that is consistent with this Privacy Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for the SPLASHVISION Network.

In the event that ownership of the SPLASHVISION Network was to change as a result of a merger, acquisition or transfer to another company, your SPLASHVISION Network information may be transferred. If such a transfer results in a material change in the use of your SPLASHVISION Network information, the SPLASHVISION Network will provide notice about the choices you have to decline to permit such a transfer.

1. 4.     Your Choices About Your SPLASHVISION Network Information

The SPLASHVISION Network provides you with access to your registration and any billing or shipping information; the ability to edit this information at the My Account area; and the ability to deactivate your registration with the SPLASHVISION Network. Additionally, some SPLASHVISION Network services (SPLASHVISION Search, for example) may offer you the ability to control what information is collected or used when you use these services.

You can make choices about how your SPLASHVISION Network information may be used by the SPLASHVISION Network to provide marketing offers to you. In order to do so, please visit the My Account area and review your SPLASHVISION Network marketing preferences. These preferences do not apply to communications that are directly related to your registration with the SPLASHVISION Network, or the fulfillment of a specific transaction you have requested (for example, a service advisory from the SPLASHVISION Network, or an acknowledgment of a purchase).

You may also choose whether the SPLASHVISION Network's affiliated providers receive personally identifiable SPLASHVISION Network information. This choice does not apply to the sharing of SPLASHVISION Network information necessary to provide you the basic functionality of the Network (for example, recognizing you as an authenticated user on affiliated providers' Web sites or services). Additionally, the SPLASHVISION Network may share personally identifiable SPLASHVISION Network information with one or more of its affiliated providers when that information is necessary to carry out a specific transaction or request you make for an offering from the Network or its affiliated providers, or as otherwise specified at the time you take advantage of that particular Network offering.

Because the choices you make in connection with your SPLASHVISION Network information may not take effect immediately, it is possible you may receive a communication during the period in which your request is being processed.

1. 5.     Cookies, Web Beacons or Similar Technologies

Cookies are text files that are placed in your computer's browser, and that can be used to help recognize you as an SPLASHVISION Network user. Web beacons are small pieces of code placed on Web pages that can be used, among other things, to count the users who visit that Web page, or to deliver a cookie to the browser of a user viewing that page. You can control cookies through your browser's settings. If you reject all cookies, however, you will not be able to take advantage of most SPLASHVISION Network offerings.

The SPLASHVISION Network may use cookies, web beacons, or similar technologies in combination with your SPLASHVISION Network information to enhance and personalize your experience on the SPLASHVISION Network, including to operate and improve offerings through the SPLASHVISION Network; to help authenticate you when you use the SPLASHVISION Network; to remember your preferences and registration information; to enable a shopping cart; to present and help measure and research the effectiveness of SPLASHVISION Network offerings, advertisements, and e-mail communications (by determining which Network e-mails you open and act upon); and to customize the content and advertisements provided to you through the SPLASHVISION Network.

The SPLASHVISION Network and its advertisers may also use ad network providers to help present advertisements on the SPLASHVISION Network and other Web sites. These ad network providers use cookies, web beacons, or similar technologies on your computer to help present, better target, and measure the effectiveness of their advertisements, using data gathered over time and across their networks of Web pages to determine or predict the characteristics and preferences of their audience. The SPLASHVISION Network may share certain non-personally identifiable information about you as a Network user (such as user age and zip code) with certain ad network providers to help them deliver more relevant advertisements through their ad networks. The use of cookies, web beacons, or similar technologies by ad network providers is subject to their own privacy policies, not the SPLASHVISION Network's.

1. 6.     Personal Financial Information

The following notice explains the SPLASHVISION Network's practices with respect to the use of personal financial information, such as SPLASHVISION Network wallet ("SPLASHVISION Network financial features"). By using SPLASHVISION Network financial features, you agree to receive future notices required under the Gramm-Leach-Bliley Act through the continuous posting of this Privacy Policy online.

The SPLASHVISION Network does not disclose portfolio or wallet information to unaffiliated third parties other than in the limited circumstances permitted by law (for example, in response to legal process), or when you ask us to disclose the information (for example, when you request that the Network share wallet information in order to facilitate a purchase). Any sharing of wallet information with the Network's affiliated providers is also subject to your choices. This policy does not apply, however, to financial information that you provide to an affiliated provider or a third party in connection with your use of their sites or offerings.

If you click through a banner advertisement on the portfolio or wallet features, and identify yourself to the advertiser (for example, by placing an order), the advertiser may be able to tell that you use that feature. No wallet information is shared with the advertiser unless you request it.

Only employees and contractors who need to know this information in order to provide this service to you are authorized to access portfolio or wallet information.

1. 7.     Our Commitment to Security

The SPLASHVISION Network has established safeguards to help prevent unauthorized access to or misuse of your SPLASHVISION Network information, but cannot guarantee that your personally identifiable information will never be disclosed in a manner inconsistent with this Privacy Policy (for example, as a result of unauthorized acts by third parties that violate applicable law or the policies of the Network and its affiliated providers). To protect your privacy and security, the SPLASHVISION Network uses passwords to help verify your identity before granting access or making corrections to any of your SPLASHVISION Network information.

We cannot, however, ensure or warrant the security of any information you transmit to SplashVision and you do so at your own risk. Once we receive your transmission of information, SplashVision makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If SplashVision learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. SplashVision may post a notice on the SplashVision Sites if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

1. 8.     Special Note for Parents

The SPLASHVISION Network is intended for a general audience, and children under the age of thirteen are not permitted to register with the SPLASHVISION Network. If any of the SPLASHVISION Network's affiliated provider’s offers a site directed toward children, or knowingly collects information from children, that affiliated provider is required to provide you information about its practices for the handling of children's online data through its privacy policy.

1. 9.     International Users

The SplashVision Sites are hosted in the United States and are intended for and directed to Users in the United States. If you are a User accessing the SplashVision Sites from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the SplashVision Sites, which are governed by U.S. law, this Privacy Notice, and our Terms of Use, you are transferring your personal information to the United States and you consent to that transfer.

11. Changes to this Privacy Policy and Additional Information

The SPLASHVISION Network may update this Privacy Policy from time to time, and so you should review this Policy periodically. If there are significant changes to the SPLASHVISION Network's information practices, you will be provided with appropriate online notice. You may be provided other privacy-related information in connection with your use of offerings from the SPLASHVISION Network, as well as for special features and services not described in this Policy that may be introduced in the future.

Your Florida Privacy Rights: Florida privacy law allows Florida residents to obtain specific disclosures about a business's privacy practices if it shares information with other companies for direct marketing purposes.
